Services
We provide portable sanitation equipment for rental on a short-term or long-term basis, including but not limited to:

All services are subject to availability in your area. Specific terms, pricing, delivery schedules, and service frequencies will be outlined in your rental agreement or order confirmation.
Rental Agreements
When you place a rental order with us, a separate rental agreement or order confirmation will be provided that includes:
- Equipment type and quantity
- Rental period and service schedule
- Pricing and payment terms
- Delivery and pickup details
- Site requirements and access conditions
That rental agreement, together with these Terms of Service, forms the complete agreement between you and Gotta Go Toilets. In the event of a conflict, the terms of your signed rental agreement will control.
Customer Responsibilities
By renting equipment from us, you agree to:
- Provide safe, unobstructed access to the delivery site for our drivers and service technicians
- Ensure the placement location is on a firm, level, and stable surface
- Not move, relocate, or attempt to transport equipment after delivery without prior written authorization from us
- Keep equipment in a reasonably clean and functional condition
- Not use equipment for any purpose other than its intended sanitation function
- Not allow equipment to be overloaded beyond its designed capacity
- Notify us promptly of any damage, vandalism, overflow, or service issues
- Ensure that the person authorizing the rental has the legal authority to do so (such as a property owner, general contractor, or authorized site manager)
Prohibited Uses
You may not use our equipment or website in connection with:
- Illegal activities of any kind
- Disposal of hazardous, chemical, or medical waste
- Any use that creates a public health or safety hazard
- Unauthorized subletting or transfer of rented equipment to a third party
Violation of these prohibitions may result in immediate retrieval of equipment, termination of service, and you may be held liable for any resulting costs or damages.
Damage and Loss
You are responsible for any damage to equipment beyond normal wear and tear that occurs during your rental period. This includes damage caused by:
- Improper use or misuse
- Vandalism occurring on your site
- Fire, vehicle impact, or other site-related incidents
- Failure to provide secure access for scheduled service
If equipment is lost, stolen, or destroyed while in your possession, you will be charged the full replacement cost. We strongly recommend that customers renting equipment for construction sites or events maintain appropriate site insurance coverage.
Delivery, Placement, and Pickup
We will make reasonable efforts to deliver and pick up equipment on the scheduled dates. Delivery and pickup times are estimates and may be affected by weather, road conditions, equipment availability, or other factors outside our control.
- You are responsible for ensuring site access on the scheduled delivery and pickup date
- If our driver is unable to access the site, a redelivery or re-pickup fee may apply
- Equipment will not be retrieved until all outstanding balances on your account are settled
Service and Maintenance
Regularly scheduled servicing is included in applicable rental agreements. Service visits include pumping, cleaning, restocking of supplies (where applicable), and basic inspection.
- You must ensure clear, safe access to equipment on each scheduled service date
- We reserve the right to reschedule service due to unsafe site conditions, weather, or other circumstances outside our control
- Emergency service requests outside your scheduled frequency may be subject to additional fees
Payment Terms
Payment terms will be specified in your rental agreement or order confirmation. Unless otherwise agreed in writing:
- Invoices are due upon receipt or by the date stated on the invoice
- Late payments may be subject to late fees as specified in your rental agreement
- We reserve the right to suspend or terminate service for accounts with outstanding balances
- All prices are subject to applicable taxes and fees
Cancellations and Early Termination
Cancellation and early termination policies will be detailed in your rental agreement. In general:
- Cancellations made with sufficient advance notice as defined in your agreement may qualify for a full or partial refund
- Early termination of a long-term rental may result in early termination fees
- We reserve the right to cancel or suspend service at any time if these Terms or your rental agreement are violated
Limitation of Liability
To the fullest extent permitted by applicable law, Gotta Go Toilets shall not be liable for:
- Indirect, incidental, special, or consequential damages arising from the use of our services or equipment
- Losses resulting from events outside our reasonable control, including weather, natural disasters, or third-party failures
- Damages resulting from your failure to comply with site, placement, or access requirements
Our total liability to you for any claim arising out of or related to your rental shall not exceed the total amount paid by you for the specific rental in question.
Nothing in these Terms limits our liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Gotta Go Toilets, its officers, employees, agents, and contractors from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:
- Your use of our equipment or services
- Your violation of these Terms or your rental agreement
- Damage, injury, or loss occurring at your site during the rental period that results from your actions or negligence
- Any claim by a third party related to your rental
Website Use
The content on gottagotoilets.com – including text, images, logos, and service descriptions – is the property of Gotta Go Toilets and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.
You agree not to use our website to:
- Transmit spam, malware, or harmful code
- Scrape, harvest, or collect data without authorization
- Impersonate us or misrepresent your affiliation with us
- Interfere with the operation of the website
Governing Law and Disputes
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict-of-law provisions. Any disputes arising under these Terms or related to our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Hinds County, Mississippi.
